ChaoMoto is an online software to manage scooter and motorbike rental shops: planning, rentals, deposits, photos and videos, contracts, payments and cash records. It is provided by Akaris Property Co., Ltd. (registration no. 0845565018229), 214/58 Moo 1, Koh Phangan, Surat Thani 84280, Thailand. By creating an account you accept these terms.
Accounts
You must give accurate information and keep your password secret. You are responsible for what is done with your account.
A shop owner can invite staff and choose their access rights. The owner is responsible for the people they invite.
You must be at least 20 years old, or act for a business that accepts these terms.
Prices and billing
The first 3 scooters in service are free. Above that, the price is 39 THB per scooter in service per month. Scooters marked as in repair are not billed.
Yearly payment: 10 months are paid for 12 months of use.
Prices are shown in Thai baht. Any applicable VAT will be shown on the invoice.
Paid subscriptions are billed in advance each month (or year). If a payment fails, we will remind you; after 7 days without payment, the account can be switched to read-only until payment.
We will announce any price change at least 30 days in advance.
No commitment, cancellation and refunds
There is no minimum period. You can stop at any time from the app or by email; the paid period runs until its end and is not renewed.
Monthly payments already made are not refunded. Yearly payments can be refunded for the full unused months if you cancel within the year.
You can ask for an export of your data before closing your account.
Your data and your customers' data
You keep ownership of all data you enter. We only use it to provide the service.
You are the data controller for your customers' personal data (including passport copies). You must have a lawful basis to collect it, inform your customers, and respect the Thai PDPA and other laws that apply to your shop (for example immigration reporting). ChaoMoto acts as your data processor, as described in our Privacy Policy.
Do not store more personal data than you need, and delete it when you no longer need it.
Acceptable use
You must not use ChaoMoto for illegal activities, upload content you have no right to use, try to access other shops' data, disrupt the service, or resell it without our written agreement.
Availability and support
We work to keep ChaoMoto available and secure, but we cannot promise it will never be interrupted. We may carry out maintenance and improve features. Support is available by email at contact@akarisproperty.com.
Payments between you and your customers
PromptPay QR codes shown in ChaoMoto send money directly to your own account. ChaoMoto does not receive, hold or guarantee payments between you and your customers, and is not a party to your rental contracts.
Liability
To the extent permitted by Thai law, we are not liable for indirect losses (such as lost profit or lost data caused by your own actions), and our total liability is limited to the amount you paid us in the 12 months before the event. Nothing in these terms limits liability that cannot be limited by law.
Suspension and closing
We may suspend an account that breaks these terms or does not pay, after a warning except in urgent cases. You can close your account at any time.
Changes to these terms
We may update these terms. We will tell account holders about important changes at least 30 days in advance. If you keep using ChaoMoto after the change, you accept the new terms.
Law and language
These terms are governed by the laws of Thailand. Disputes will first be discussed in good faith, then brought before the competent Thai courts. These terms exist in Thai and English.
